2. Applicability
2.1 These General Terms and Conditions apply to all offers, orders, agreements and deliveries of products via www.bardeau.store .
2.2 By placing an order on By using www.bardeau.store you agree to these Terms and Conditions.
2.3 Bardeau reserves the right to amend these terms and conditions. The version in effect at the time of ordering applies to the order in question.
3. Offer and products
3.1 The offer on the website is non-binding. Obvious errors or mistakes in the offer (e.g., typographical errors, pricing errors, or incorrect product information) are not binding on Bardeau.
3.2 Product colors may vary slightly on your screen. Bardeau cannot guarantee that the displayed colors exactly match the actual product colors.
3.3 If a product is no longer available after you place your order, Bardeau will contact you. You will then be given the choice of an alternative product (if available) or a refund of the amount paid.
4. Prices and payments
4.1 All prices on the website are in euros (EUR) and include VAT , but exclude shipping costs, unless stated otherwise.

5. Conclusion of the agreement
5.1 The agreement is concluded when you place an order via the webshop and the payment has been successfully completed.
5.2 After placing an order, you will receive an automatic order confirmation at the email address you provided. If you haven't received this confirmation, you can contact Bardeau at hello@bardeau.nl. .
5.3 Bardeau reserves the right to refuse an order, for example when:

a product is no longer in stock;

there is an obvious error in the price or description;

the payment has not been authorized or completed.
In that case you will receive a message and, if applicable, the paid amount will be refunded.

6.4 The order will be shipped via PostNL and/or DHL, or another carrier chosen by Bardeau.
6.5 The stated delivery times are indicative. Exceeding a delivery time does not automatically entitle you to compensation. In the event of a significant delay, you can contact us to discuss a suitable solution.
6.6 Shipping to countries outside the EU may be subject to import duties, customs fees, and/or local taxes. These are the recipient's responsibility.
6.7 The risk of damage or loss of products remains with Bardeau until delivery to you or a person designated by you. After that, the risk passes to you.
7. Accounts
7.1 You can create an account on the website, but it's not required. Ordering as a guest is also possible.
7.2 You are responsible for keeping your login details confidential and for restricting access to your account.
8. Right of withdrawal and returns
8.1 As a consumer, you have the right to cancel your order (of non-personalised products) within 30 days of receipt without giving any reason (right of withdrawal).
8.2 The 30-day reflection period commences on the day after you, or a third party designated by you (not the carrier), has received the product.
8.3 If you wish to exercise your right of withdrawal, you can:

send an email to info@bardeau.store with your order details; or

use a return form (if available) on the website.
8.4 After registering your return, you then have another 14 days to actually return the product.
9. Return Conditions
9.1 You may try on the product as you would in a physical store. If the product has been used more than necessary to determine its nature, characteristics, and functioning, you may be charged for any diminished value.
9.2 Products must, to the extent possible:

to be unworn;

unwashed;
-
in original condition;
-
with all attached labels and included accessories.
9.3 The products must be returned in the original packaging as much as possible.
9.4 Excluded from returns:

Personalized or custom-made products (e.g. products with a specific print or name);

Hygiene products which, for reasons of health protection or hygiene, are not suitable for return once the seal has been broken (for example underwear, if in the range).
10. Return Shipping Costs and Refund
10.1 The costs for returning the products are borne by the customer, unless expressly stated otherwise on the website or otherwise agreed in advance.
10.2 Within 7 days after the return shipment has been received and inspected by Bardeau, the purchase amount (including any standard shipping costs paid for the outward shipment) will be refunded via the same payment method you used for payment, unless otherwise agreed.
10.3 If the product is damaged, shows signs of use, or is incomplete, Bardeau may charge a depreciation fee. This will be communicated in advance by email.
11. Uncollected package
11.1 If you do not collect a package from the collection point within the time limit set by the carrier and the package is therefore not returned to Bardeau or only after a long period of time, Bardeau may charge costs for this or decide not to provide a full refund.
11.2 If a package is returned as "uncollected" or "undeliverable," Bardeau will contact you to find a suitable solution, such as:

resend (against payment of new shipping costs); or
-
(partial) refund, depending on the condition of the return shipment and costs incurred.
12. Discount codes, credit codes and promotions
12.1 Bardeau may offer discount codes and promotions. The terms and conditions (validity period, minimum order amount, etc.) are communicated for each promotion.
12.2 Discount codes:

are not exchangeable for cash;
-
are personal or general, depending on the action;
-
may have a limited period of validity;
-
cannot be combined with other promotions unless otherwise stated.
12.3 Credit codes (e.g. store credit) are valid for one year after issue, unless otherwise stated.
12.4 If you return an order (partially) that included a discount code, the discount will be deducted pro rata. The discount itself will not be refunded in cash.
13. Liability
13.1 Bardeau is not liable for indirect, incidental, or consequential damages, such as lost profits, lost savings, or damage due to business stagnation.
13.2 Bardeau's total liability to you for attributable failures to perform an agreement is limited to the amount of the relevant order.
13.3 The limitations in this article do not apply in the event of intent or deliberate recklessness on the part of Bardeau.
14. Intellectual property
14.1 All designs, prints, logos, texts, photos, videos, and other content on the Bardeau website are protected by copyright and/or other intellectual property rights.
14.2 It is not permitted to copy, reproduce, distribute or otherwise use these works without prior written permission from Bardeau.
15. Force Majeure
15.1 In the event of force majeure, Bardeau is not obligated to fulfill its obligations. Force majeure includes, but is not limited to: internet or other telecommunications disruptions, power outages, transport disruptions, strikes, government measures, war, natural disasters, pandemics, fire, import or export restrictions, and delivery service disruptions.
15.2 If a force majeure situation lasts longer than 30 days, both you and Bardeau have the right to terminate the agreement in writing. Any amounts already paid for products not yet delivered will then be refunded (pro rata).
16. Complaints
16.1 If you have a complaint about a product or Bardeau's service, you can send an email to info@bardeau.store . Describe your complaint as clearly as possible and attach photos if necessary.
16.2 Bardeau aims to respond to your complaint within a reasonable period of time (for example within 5 working days).
17. Applicable law
17.1 All agreements between you and Bardeau are governed by Dutch law .
17.2 Disputes can be submitted to the competent court in the Netherlands.
